First Expert Witness Project for 2011

Dr. Box Consulting completed an Expert Witness, Machine Assessment and Valuation project in January 2011 that reduced our client’s exposure by over 70% and over $1 million. It consisted initially of writing expert testimony for court and conducting a Fair Market Value of equipment damaged in a disaster. The equipment was a one of a kind version of an uncommon corrugated machine. The next phase required an onsite visit to evaluate each individual component of the machine and determine the condition of the equipment before and after the disaster. From this a build cost was determined, a rebuild cost was determined, a true value based on the unique machine was established and capabilities were assessed. The final report contained all of the proof needed to determine the true liability of the client in spite of multiple quotes indicating much higher values. The overall result was over $1 million reduction in the amount that the opposing council was willing to settle for. This generated over a 5000% ROI for the customer by using Dr. Box Consulting services.

Throughout 2009 and 2010 I defended a property loss case at a commercial warehouse which included the destruction of a number of custom built and unique large scale pieces of industrial machinery. Among the items damaged was a cascader type wax machine. After an extensive review for expert witnesses to help defend the case, Randy Phares’ name was continually referred as the most knowledgeable engineer in the corrugated box industry. “Dr. Box” was a tremendous help in defending this lawsuit. First Lacy Act Project of 2011

The Lacy Act is the longest standing wildlife protection law in the United States. Due to illegally harvested, acquired, transported and distributed wood and many products made from wood and wood fiber there have been several changes to the legislation in recent years. Fines up to $500,000 and 5 years of imprisonment may await those being involved in such actions. You do not have to know that illegal wood was used or even be aware of the regulation to be guilty of violating the statute and subject to the fines and prison time. Strict reporting requirements are necessary for many uses of wood based products. Within the last several years there have been many reports (some substantiated and others not) of illegally harvested wood in many countries throughout the world. If any of this became part of your product in any way then you were in violation.
